ฉัตรสุมน พฤฒิภิญโญสิริพันธ์ พลรบChardsumon PrutipinyoSiriphan Polrobมหาวิทยาลัยมหิดล. คณะสาธารณสุขศาสตร์. ภาควิชาบริหารงานสาธารณสุข2018-11-282018-11-282561-11-282558วารสารกฎหมายสุขภาพและสาธารณสุข. ปีที่ 1, ฉบับที่ 3 (ก.ย.-ธ.ค. 2558), 208-2282408-249Xhttps://repository.li.mahidol.ac.th/handle/123456789/36883การศึกษานี้มีวัตถุประสงค์ของการศึกษาเพื่อ 1) ศึกษาแนวทางการปรับปรุงฐานะ รูปแบบ และภารกิจขององค์กรปกครองส่วนท้องถิ่นของไทย กรณีศึกษาองค์กรบริหารส่วนตําบล 2) ศึกษาปัญหาอุปสรรคของการดําเนินงานขององค์กรปกครองส่วนท้องถิ่น: กรณีศึกษาองค์กรบริหารส่วนตําบล โดยใช้การศึกษารวบรวบข้อมูลที่เป็นเอกสาร โดยรวบรวบข้อมูลจากเอกสารเกี่ยวข้องต่างๆ เป็นหลักวิธีค้นหาข้อมูลจาก “คําสําคัญ (Key words)” ผลการศึกษา พบว่า แนวทางการปรับปรุงฐานะองค์กรปกครองส่วนท้องถิ่นด้วยการยกฐานะจากอบต. ขึ้นเป็นเทศบาลให้ตราเป็นประกาศกระทรวงมหาดไทยโดยมีหลักเกณฑ์ และขั้นตอนจัดตั้งเป็นเทศบาลตําบลโดยมาตรา 42 วรรคแรกแห่งพระราชบัญญัติสภาตําบลและองค์การบริหารส่วนตําบล พ.ศ. 2537 และมาตรา 9 มาตรา 12 แห่ง พ.ร.บ. เทศบาล พ.ศ. 2496 ซึ่งมีเงื่อนไขที่ขึ้นอยู่กับรายได้และขนาดของประชากรเป็นหลัก โดยต้องแสดงเหตุผลและความเห็นขององค์การบริหารส่วนตําบลและได้รับความเห็นชอบจากนายอําเภอและผู้ว่าราชการจังหวัดตามลําดับ ปัญหาและอุปสรรคในการปรับปรุงฐานะขององค์การบริหารส่วนตําบลมีสาเหตุมาจาก 1) อํานาจของผู้บริหารในระดับพื้นที่การปรับปรุงฐานะการปกครองทําให้ผู้บริหารอบต. สูญเสียตําแหน่ง 2) ความสามารถทางการคลังและการจัดการรายได้และ 3 ปัญหาประชากร ในบางพื้นที่มีการเคลื่อนไหวประชากรมาก การศึกษานี้ผู้วิจัยมีข้อเสนอแนะให้มีการจัดทํามาตรการบังคับเพื่อให้ฐานะของ อบต. มีความเหมาะสม ทั้งขนาด ประชากร รายได้และการออกกฎหมายให้ประชากรในพื้นที่สามารถลงมติปรับปรุงโครงสร้างองค์การบริหารส่วนตําบล หน่วยกํากับดูแลควรจัดมีการลงชื่อเพื่อควบรวมประชาชนสามารถเข้ามามีส่วนร่วมในการลงมติเรื่องการขยายขอบเขตหน่วยการปกครอง หน่วยงานที่มีหน้าที่ในการกํากับดูแลอบต. ได้แก่ ผู้ว่าราชการจังหวัดโดยนายอําเภอ และเจ้าหน้าที่ที่เกี่ยวข้องซึ่งมีหน้าที่ตามกฎหมายโดยดําเนินการพัฒนาศักยภาพในการกํากับดูแลอบต.This study aimed to 1) study the ways to improve status and mission of the Thai local administration organization Thailand 2) study the problems of the local administration organization. This is a documentary, qualitative legal research collecting relevant various documents related primarily from searching the "key words ". The results indicated that guideline for improving status of local administration organizations was to promote Subdistrict (Tambon) Administration Organizations [Or Bor Tor] to municipalities by enacting the Interior Ministry Annoucement and by applying the criteria and procedure established by article 42 Clause 1 of the Tambon Council and Tambon Administration Authority Act B.E 2537, and article 9, 12 of the Municipal Act B.E. 2496. To promote Or Bor Tor to Municipalities, income and population size must be taken into account. Opinions on the promotion must go through district, province, and Interior Ministry, respectively. Problem and obstacles to promotion of Or Bor Tor to municipalities were 1) loss of power of local administrations; 2) financial and management abilities; and 3) excessive population migration in some area. From this study, results suggested that in order to make the Or Bor Tor status having a proper size of population and income, controlling measures should be operated. Moreover, a consensus from local people must be achieve to adjust structure of Or Bor Tor. Additionally, regulatory authorizes should provide community participation in voting on administrative areas expansion.
