Abstract

โครงการประเมินนี้มีวัตถุประสงค์เพื่อศึกษากระบวนการถ่ายทอดและแนวทางการบังคับใช้กฎหมาย สุขภาพของภาครัฐไปสู่ผู้ผลิต ผู้นำเข้าและผู้ประกอบการผลิตภัณฑ์ยาสูบ ศึกษาการตรวจแนะนำและการบังคับ ใช้ข้อกฎหมายของภาครัฐไปสู่ผู้ประกอบการร้านค้าปลีก ร้านสะดวกซื้อ รวมทั้งศึกษาปัญหา อุปสรรคของ กระบวนการถ่ายทอดและบังคับใช้กฎหมายของเจ้าหน้าที่ภาครัฐไปสู่ผู้ปฏิบัติ วิธีการศึกษาคือการจัดโครงการ จัดสัมมนาเพื่อซักซ้อมความเข้าใจในการปฏิบัติตามพระราชบัญญัติควบคุมผลิตภัณฑ์ยาสูบ พ.ศ. 2560 สำหรับ ผู้ผลิต ผู้นำเข้า และผู้ประกอบการธุรกิจผลิตภัณฑ์ยาสูบ ลงพื้นที่ เพื่อตรวจแนะนำและการแจ้งข่าวสารกฎหมาย ของเจ้าหน้าที่รัฐไปสู่ผู้ปฏิบัติรวมทั้งสัมภาษณ์เจ้าหน้าที่ที่เกี่ยวข้องกับการถ่ายทอดและบังคับใช้กฎหมายถึง ปัญหาและอุปสรรคที่เกิดจากกระบวนการถ่ายทอดและบังคับใช้กฎหมายในกลุ่มงานพัฒนาและบังคับใช้ กฎหมายของสำนักควบคุมการบริโภคยาสูบ วิเคราะห์ข้อมูลโดยใช้สถิติร้อยละ ค่าเฉลี่ย การทดสอบค่าที (Independent t-test) และการวิเคราะห์ความแปรปรวนทางเดียว (One Way ANOVA) ผลการประเมิน พบว่า ผู้ผลิต ผู้นำเข้า ผู้ประกอบการธุรกิจผลิตภัณฑ์ยาสูบส่วนใหญ่มีความรู้และ ความเข้าใจในสาระสำคัญของกฎหมายตามพระราชบัญญัติควบคุมผลิตภัณฑ์ยาสูบ พ.ศ. 2560 อยู่ในระดับดี ความเข้าใจเจตนารมณ์และสาระสำคัญของข้อบทกฎหมาย ความสามารถในการนำความรู้ที่ได้รับไปประยุกต์ใช้ ในการปฏิบัติงาน ความสามารถนำความรู้ไปเผยแพร่ถ่ายทอดแก่ผู้เกี่ยวข้อง และความมั่นใจและความสามารถ นำความรู้ที่ได้รับไปปฏิบัติได้คะแนนอยู่ในระดับดี ร้านค้าปลีกและร้านสะดวกซื้อที่จำหน่ายบุหรี่ให้ความร่วมมือ ในการปฏิบัติตามกฎหมายดี ปัญหา อุปสรรคในจากกระบวนการถ่ายทอดและบังคับใช้กฎหมายของเจ้าหน้าที่ ภาครัฐไปสู่ผู้ปฏิบัติ คือ ยังขาดแคลนบุคคลากรในระดับท้องถิ่น รวมทั้งองค์กรและบุคลากรที่ทำงานควบคุม ยาสูบอย่างจริงจัง

This evaluation project has the objective of studying the process of informing and guiding the enforcement of public health law to the manufacturers, importers and entrepreneurs of tobacco products, including studying, guiding, and enforcing the laws of the public sector to retailers, and convenient stores. This project also studies the problems, and obstacles of communicating process and enforcement of the law by government officials. This study was conducted through organizing seminars in order to practice for mutual understanding of the Tobacco Products Control Act, BE 2560’s implementation, for manufacturers, importers, and entrepreneurs of tobacco products. State officials and staff in the Tobacco Control Development and Enforcement Working Group who were involved with communication and enforcement of the law, were interviewed about problems and obstacles. Data were analyzed using percentage, mean, independent t-test and one-way analysis of variance (ANOVA). The results indicated that the majority of the manufacturers, importers and entrepreneurs of tobacco product had a good level of knowledge and understanding of the law under the Tobacco Products Control Act, BE 2560. They had good understanding of the intent and substance of the law. They had a good level of ability to apply knowledge to the application of the work. They had a good level of ability to bring knowledge to inform those who were involved. They also had a good level of confidence and ability to apply the knowledge gained. Retailers and convenient stores who sell tobacco products cooperated in complying with the law. The problems and obstacles in the process of communicating and enforcing the law by government officials is lacking of personnel at the local level, Including agencies and personnel who are motivated to put an effort to participate in tobacco control work.
