Abstract

การนำหลักการประเมินผลกระทบในการออกกฎหมายไปประยุกต์ใช้ยังมีผลดีต่อ ภาพลักษณ์ของการเป็น “รัฐบาลที่ดี” ตามหลักการประชาธิปไตยด้วย ทั้งยังสนับสนุนการปกครอง ตามหลักนิติธรรมภายใต้กฎหมายที่ได้สัดส่วนและเป็นธรรม กรอบการประเมินผลกระทบในการออก กฎหมายประกอบด้วยการวิเคราะห์ปัญหาและวัตถุประสงค์ของข้อเสนอให้มีกฎหมาย การอธิบาย ทางเลือกอื่นเพื่อบรรลุวัตถุประสงค์ที่กำหนด การประเมินผลกระทบที่สำคัญทั้งผลกระทบทางบวก และทางลบ ตลอดจนการประเมินผลที่จะได้รับและต้นทุนต่อผู้บริโภค ภาคธุรกิจ และกลุ่มผู้มีส่วนได้ เสียอื่น การปรึกษาหารือกับผู้เกี่ยวข้องและผู้มีส่วนได้เสียอื่น ตลอดจนการเสนอแนะทางเลือกที่ เหมาะสม และเหตุผลสนับสนุน การประเมินผลกระทบทำให้รัฐบาลเป็นรัฐบาลที่มีความรับผิดชอบ เพราะต้องมีการประเมินต้นทุนและประโยชน์ที่ได้รับของนโยบายอย่างรอบคอบ ซึ่งช่วยให้สามารถ กำหนดนโยบายได้อย่างเหมาะสมโดยคำนึงถึงความคุ้มค่าและผลที่จะเกิดขึ้นว่าภาคส่วนใดจะได้ ประโยชน์อะไร อย่างไร และภาคส่วนใดจะเสียประโยชน์อะไร อย่างไร การรับฟังความคิดเห็นของผู้มี ส่วนได้เสียจะช่วยสร้างความชอบธรรม ความเป็นธรรม และความยุติธรรมในสังคม

Having application guidelines for impact assess is good for the government public image of being a "Good government", according to democratic principles. It also supports ruling by the legal principles under the law of proportionality and fairness. The frame of legislation impact evaluation composes of problem analysis and objectives of the drafted law proposal, describing alternatives to achieve the objectives indicated, and the needs to assess both positive and negative impacts. The evaluation will include costs effectiveness for consumers, businesses and other stakeholders, as well as suggesting other suitable alternatives, and supporting reasons. Impact assessment will bring out a government with accountability, because there must be an assessment of the costs and benefits of the policy carefully. This allows policy formulation process appropriately, with cost-benefit ratio in mind and finding out which sector will be beneficial or not, and how. Listening to the opinions of stakeholders are helpful with creating legitimacy, fairness and justice in society.
