กฎหมายกับการควบคุมมลภาวะทางอากาศ

Abstract

ประเทศไทยมีกฎหมายที่เกี่ยวข้องกับการรักษาสภาพแวดล้อมอยู่หลายฉบับ สำหรับ พ.ร.บ. ส่งเสริมและรักษาคุณภาพสิ่งแวดล้อม พ.ศ. 2535 ซึ่งถือเป็นกฎหมายกลางในการรักษาสภาพแวดล้อม ปัญหาของกฎหมายควบคุมมลพิษทางอากาศเกิดจากหลายสาเหตุ อาทิเช่น 1. กฎหมายยังขาด มาตรการจูงใจ ในการควบคุมกระบวนการผลิต 2. การลงโทษให้ประจักษ์ชัดตามความรุนแรงของการ กระทำ 3. การติดตามตรวจสอบผลกระทบสิ่งแวดล้อม รวมถึง 4. ปรากฏการณ์ธรรมชาติ อาทิ เช่น ปรากฏการณ์เรือนกระจกที่เกิดขึ้นเพราะโลกจะได้รับพลังงานจากดวงอาทิตย์ที่ส่องผ่านบรรยากาศลงมา อยู่อย่างสม่ำเสมอ การเปลี่ยนแปลงรูปแบบของการเกษตรกรรมและการพัฒนาอุตสาหกรรม มีผลทำให้ โลกร้อนขึ้นด้วยสาเหตุที่ทำให้ปริมาณก๊าซชนิดต่างๆ ที่กล่าวมาแล้วเพิ่มขึ้น ส่วนปัญหาการควบคุม มลภาวะทางอากาศระหว่างประเทศ สำหรับกรณีมลพิษหมอกควันข้ามแดนจะต้องประสานเพื่อ ดำเนินการแก้ไขปัญหาทั้งในระดับพหุภาคีและทวิภาคีตามข้อกำหนดในข้อตกลงอาเซียน เรื่องมลพิษ จากหมอกควันข้ามแดนในพื้นที่อนุภูมิภาคแม่น้ำโขง อย่างไรก็ตาม ประเทศไทยต้องดำเนินการอนุวัติ การกฎหมายให้เป็นไปตามอนุสัญญาฯ และพิธีสารฯ ใน 3 มาตรการ คือ มาตรการทางกฎหมายในการ ป้องกัน ในการควบคุมและจัดการแก้ปัญหา และ ในการฟื้นฟูแก้ไขปัญหา โดยมาตรการทางกฎหมายใน การป้องกันถือเป็นพันธกรณีที่สำคัญ ได้แก่ การเพิ่มบทบาทการมีส่วนร่วมของประชาชน ชุมชน ท้องถิ่น การให้สิทธิหน้าที่แก่ประชาชนในการจัดการทรัพยากรฯ และการจัดกิจกรรมรณรงค์ป้องกันหมอกควัน ไฟป่า

Thailand has many laws relating to the environmental protection. The Environmental Quality Act B.E. 2535, is considered a main law in the environmental protection. The problem of air pollution control law is due to many causes, such as: 1. The law still lacks incentives in industrial production operations; 2. Punishment is manifested by the severity of the action; 3. Monitoring of the environmental impact; and 4. Natural phenomena, such as the greenhouse effect caused by the energy from the sun through the atmosphere regularly, changing patterns of agriculture and industrial development. These are causes for global warming, which causes the increase in various amount of gaseous. The problem of air pollution control, in the case of cross-border haze pollution, coordination would be needed to address both multilateral and bilateral issues in accordance with the ASEAN Framework Agreement on Climate Change. However, Thailand has to comply with the Convention on Laws and the Protocol in three measures, namely, legal measures to protect the environment, to control, finding solutions, and rehabilitate environmental conditions. Legal measures for protection are important obligations, such as increasing the role of local people, the local community, the rights of people in the management of resources, and the campaign to prevent forest fires.
