มาตรการทางกฎหมายไทยและกฎหมายระหว่างประเทศที่เกี่ยวกับการค้าผลิตภัณฑ์ยาสูบที่ผิดกฎหมาย

Abstract

การเข้าร่วมเป็นภาคีพิธีสารว่าด้วยการขจัดการค้าผลิตภัณฑ์ยาสูบที่ผิดกฎหมายจะทำให้ได้รับความร่วมมือช่วยเหลือทางเทคนิคระหว่างประเทศในส่วนที่เกี่ยวข้องกับการบังคับใช้กฎหมายในเรื่องต่าง ๆ เช่น การสอบสวนคดีข้ามพรมแดน การใช้อำนาจศาล และการส่งผู้ร้ายข้ามแดนที่ถูกกล่าวหาว่าเป็นผู้กระทำผิด แนวทางการพัฒนากฎหมายและมาตรการเพื่อขจัดการค้าผลิตภัณฑ์ยาสูบที่ผิดกฎหมายตามพันธกรณีของประเทศไทยมี 3 กลุ่ม ดังนี้ 1) กลุ่มการควบคุมห่วงโซ่อุปทาน ตรวจสอบและติดตามผลิตภัณฑ์ยาสูบทั้งหมด และใบอนุญาตสำหรับผู้ผลิตผู้นำเข้าและผู้ส่งออกผลิตภัณฑ์ยาสูบและอุปกรณ์การผลิต การดำเนินการตามกฎหมายที่ควบคุมการเก็บบันทึกและการขายผลิตภัณฑ์ยาสูบทางอินเทอร์เน็ต 2) กลุ่มความผิด ควรอยู่ภายใต้ความรับผิดทางอาญาที่ได้สัดส่วน การใช้มาตรการการอายัดเงิน และการกำจัดหรือทำลายบุหรี่ ผลิตภัณฑ์ยาสูบ และอุปกรณ์การผลิตที่ยึดได้ และ 3) กลุ่มความร่วมมือระหว่างประเทศ โดยบังคับใช้ข้อมูลร่วมกันระหว่างภาคีเพื่อต่อต้านการค้าผลิตภัณฑ์ยาสูบที่ผิดกฎหมาย ความช่วยเหลือและความร่วมมือระหว่างประเทศเพื่อสร้างขีดความสามารถและร่วมมือกัน เพิ่มโปรแกรมเพื่อเพิ่มขีดความสามารถของหน่วยงานบังคับใช้กฎหมายและความช่วยเหลือทางเทคนิคเกี่ยวกับการสอบสวนและการดำเนินคดีความผิดและการแบ่งปันข้อมูล

By joining the Protocol on Elimination of Illegal Tobacco Products Trade, there will be international technical assistance, related to law enforcement on a number of matters. For example, cross-border investigation cases, jurisdiction of justice, and extradition of alleged criminals. There are three groups of guidelines for the development of laws and measures, to eliminate illicit trade in tobacco products, according to Thailand’s obligations: 1) Supply Chain Control; Comprehensive track and trace for all tobacco products; and licenses for manufacturers, importers and exporters of tobacco products and equipment for cigarette production; should be implemented under the laws related to records keeping, and sales of tobacco products on the Internet 2) The penalty section should be subjected to a criminal liability that is proportionate; seizure of capital; and disposal or destruction measures of illegal tobacco products and equipment. 3) International cooperation on information-sharing among the Parties to combat illegal trade in tobacco products; international technical assistance and cooperation for capacity building; increase programs to enhance the capacity of law enforcement, and technical assistance in connection with investigation and prosecution of offenders, and information sharing.
