การก่อตัวและการถูกใช้งานของข้อบังคับจรรยาบรรณทันตแพทย์

Abstract

งานวิจัยชิ้นนี้แบ่งออกเป็นการศึกษาที่มาของข้อบังคับจรรยาบรรณแห่งวิชาชีพทันตกรรมและวิเคราะห์การถูกใช้งานในปัจจุบัน มีวัตุประสงค์เพื่อสร้างคำอธิบายว่าจรรยาบรรณก่อตัวขึ้นมาได้อย่างไรและถูกใช้งานเพื่อมุ่งสร้างประโยชน์ให้กับประชาชนอย่างไร เป็นการศึกษาด้วยวิธีวิจัยเชิงคุณภาพ ได้แก่การวิจัยเอกสารและ การสัมภาษณ์เชิงลึกผู้เกี่ยวข้อง ผ่านแนวคิดการวิเคราะห์วาทกรรมของ มิเชล ฟูโกต์ ผลการศึกษาพบว่า การก่อตัวขึ้นมาของข้อบังคับจรรยาบรรณ เกิดขึ้นจากการเข้ามาของการแพทย์สมัยใหม่ที่จำเป็นต้องปรับเปลี่ยนระบบการแพทย์ดั้งเดิมให้กลายเป็นระบบเดียวกันทั้งประเทศภายใต้วาทกรรมวิทยาศาสตร์การแพทย์ ทำให้มีลักษณะทางจริยธรรมอยู่ 2 ลักษณะ ได้แก่ 1) "จริยธรรมในเชิงวิชาชีพ" (professional ethics) ที่มีองค์ความรู้ทางการแพทย์คอยกำกับว่าหากผู้ป่วยมีอาการอะไร จะต้องตรวจอย่างไร และมีการรักษาใดบ้างที่เหมาะสม นอกจากนี้ยังมีสาขาวิชาจริยศาสตร์ชีวภาพ (bioethics) ที่ถกเถียงเรื่องที่ว่าด้วยการปฏิบัติต่อมนุษย์และสิ่งมีชีวิต 2) "จริยธรรมในเชิงประเพณี" (traditional ethics) ถูกสร้างขึ้นมาเพื่อจัดระเบียบระบบการแพทย์ดั้งเดิมให้อยู่ภายใต้วาทกรรมของการแพทย์สมัยใหม่ ผ่านกระบวนการทางกฎหมายในรูปข้อบังคับต่างๆ เพื่อให้การแพทย์กลายเป็นรูปแบบเดียวกันทั้งประเทศ ซึ่งที่ผ่านมาถูกสร้างขึ้นเพื่อควบคุม "หมอจอมปลอม" ที่ไม่ได้ขึ้นทะเบียนอนุญาตแต่ลักลอบให้บริการตรวจรักษา รวมทั้งเรื่องเจ้าของสถานพยาบาลที่ปล่อยปละละเลยให้มีผู้ที่ไม่ได้ขึ้นทะเบียนลักลอบให้บริการทางทันตกรรม ดังนั้นการถูกใช้งานของจรรยาบรรณวิชาชีพในเชิงประเพณีจึงเป็นการมุ่งสร้างเสถียรภาพของวิชาชีพ เน้นให้ภาพลักษณ์ของวิชาชีพมีเกียรติ เชื่อถือได้ ภายใต้การควบคุมตลาดบริการทางทันตกรรมโดยองค์กรวิชาชีพ ไม่ให้เกิดการแก่งแย่งแข่งขันกันเองระหว่าง

This research studied the construction of the Code of Ethics of the Dental Profession and analysed the current practice, which aimed to shape the definition of how it has been developed and utilised for the benefit of the citizens. The research adopted qualitative method, which included documentary research and in-depth interview of key informants using the approach of Discourse Analysis by Michel Foucault. The result suggests that the formation of the Code of Ethics was due to the introduction of modern medicine had to transformed the folk medicine into the part of professional medical system for the whole country, which was subjected to the Discourse of medical science. The transforming of traditional medicine led to two characteristics of ethics: 1) Professional ethics concerns medical knowledge guiding medical professionals in terms of symptoms, diagnosis, and medication. Bioethics has also been included, which discusses practices on human and other living things. 2) Traditional ethics intends to organise folk medicine, which is based on the modern medical discourse in forms of regulations through legislative procedures to meet the purpose of professional medical collectivisation. In the past, it was focused on controlling quack doctor who performed medical procedures without being registered to obtain practitioner license. Nonetheless, this depends on the nonfeasance of hospital owner allowing unregistered person to perform dental services. The practice of traditional ethics of ethical code aims to achieve professional stability, emphasising the identity of profession to be honourable and reliable, reducing competitiveness among dentists under the control of dental service market from professional institution while overlooking the unequal relationship between patients and dentists.
