การปฏิบัติตามบทบาทของญาติในการดำเนินตามกฎหมายเกี่ยวกับการทำนิติกรรมของผู้ป่วยที่มีภาวะสมองเสื่อม

Abstract

การวิจัยครั้งนี้เป็นการวิจัยเชิงพรรณนามีวัตถุประสงค์เพื่อประเมินระดับการปฏิบัติตามบทบาทของ ญาติในการดำเนินตามกฎหมายเกี่ยวกับการทำนิติกรรมของผู้ป่วยที่มีภาวะสมองเสื่อม ศึกษาคุณลักษณะประชากร ระดับความรู้ ทัศนคติ การสนับสนุนทางสังคม และวิเคราะห์หาความสัมพันธ์ระหว่างคุณลักษณะประชากร ระดับ ความรู้ ทัศนคติ การสนับสนุนทางสังคม กับการปฏิบัติตามบทบาทของญาติในการดำเนินตามกฎหมายเกี่ยวกับ การทำนิติกรรมในผู้ป่วยที่มีภาวะสมองเสื่อม กลุ่มตัวอย่างคือญาติผู้ป่วยที่มีภาวะสมองเสื่อมจำนวน 125 คน เก็บ รวบรวมข้อมูลโดยใช้แบบสอบถาม วิเคราะห์ข้อมูลโดยใช้สถิติ ร้อยละ ค่าเฉลี่ย ส่วนเบี่ยงเบนมาตรฐาน และ Chisquare test ผลการวิจัยพบว่า ญาติผู้ป่วยที่มีภาวะสมองเสื่อมปฏิบัติตามบทบาทในการดำเนินตามกฎหมาย เกี่ยวกับการทำนิติกรรมของผู้ป่วยที่มีภาวะสมองเสื่อมอยู่ในระดับต่ำ ร้อยละ58.4 มีความรู้เรื่องกฎหมายที่เกี่ยวกับ การทำนิติกรรมอยู่ในระดับต่ำร้อยละ 55.2 ทัศนคติต่อการดำเนินตามกฎหมายที่เกี่ยวข้องกับการทำนิติกรรมของ ผู้ป่วยที่มีภาวะสมองเสื่อมไปในทางบวกร้อยละ 88 มีการสนับสนุนทางสังคมอยู่ในระดับปานกลางร้อยละ 89.6 และจากการวิเคราะห์หาความสัมพันธ์ พบว่า ความรู้เรื่องกฎหมายเกี่ยวกับการทำนิติกรรมและการสนับสนุนทาง สังคม มีความสัมพันธ์กับการปฏิบัติตามบทบาทของญาติในการดำเนินตามกฎหมายเกี่ยวกับการทำนิติกรรมของ ผู้ป่วยที่มีภาวะสมองเสื่อมอย่างมีนัยสำคัญทางสถิติ (p-value<0.05) ในขณะที่คุณลักษณะส่วนบุคคลและทัศนคติ ไม่มีความสัมพันธ์กับการปฏิบัติตามบทบาทของญาติในการดำเนินตามกฎหมายเกี่ยวกับการทำนิติกรรมของผู้ป่วย ที่มีภาวะสมองเสื่อม จากการศึกษาครั้งนี้มีข้อเสนอแนะ คือ โรงพยาบาลควรส่งเสริมและสนับสนุนการให้ความรู้ด้าน กฎหมายที่เกี่ยวข้องการทำนิติกรรมแก่ญาติ ประชาสัมพันธ์ทั้งในรูปแบบสื่อต่างๆ ได้แก่ การจัดทำเว็บไซด์ สื่อ โทรทัศน์ สื่อฟรีทีวี ทวีดิจิตอล สื่อสิ่งพิมพ์ นอกจากนี้ควรสนับสนุนให้มีการจัดตั้งคลินิกให้คำปรึกษาทางกฎหมาย (Law Clinic) ให้คำปรึกษาข้อกฎหมายเกี่ยวกับการทำนิติกรรมจากนักกฎหมาย เพื่อให้ญาติและผู้ป่วยสามารถ นำเอาความรู้ คำแนะนำต่างๆ ไปดำเนินการด้านกฎหมายได้อย่างถูกต้องและเหมาะสม

The research was a descriptive study with the objective of assessing the level of compliance of relative s' role in following the law relating to making juristic act of dementia patients, studying population characteristics, the level of knowledge, attitudes and social support including analyzing the association between those variables with the compliance to the role in following the law by the relatives. The studied sample were 125 relatives of dementia patients. The data collecting tools were questionnaires statistics to be used for data analysis were percentage, mean, standard deviation and Chi-square test. The study found that that the relatives had a low compliance with the law of the compliance of relative s' role in following the law relating to making juristic Act of dementia patients of 58.4%, 55.2% had a low level of knowledge, 88% had a positive attitude toward the law, and 89.6% had a medium level of social support. Association analysis found that knowledge and social support had an association with the compliance of relative s' role in following the law relating to making juristic Act of dementia patient with statistical significance (p-value<0.05), but personal characteristics and attitude had no association. The research recommendations were hospitals should promote and support the relative s' education about the law relating to making a juristic act through many forms of public relations e.g. Website, television (free and pay), printed media. In addition, a law clinic should also be the set up about related laws for the relatives and patients to be able to apply knowledge and advice in making appropriate and correct juristic matters.
