การศึกษาวิจัยนี้ มีวัตถุประสงค์เพื่อศึกษาบริบทกระบวนการดำเนินการให้ความช่วยเหลือทางกฎหมายด้านการสนับสนุนเงินช่วยเหลือในกระบวนการยุติธรรม ตลอดจนศึกษาแนวทางการบริหารจัดการเพื่อสร้างความเติบโตและความยั่งยืนของกองทุนยุติธรรมสำหรับประเทศไทย ดำเนินการเก็บข้อมูลโดยการศึกษาทางเอกสารและการสัมภาษณ์เชิงลึกผู้ทรงคุณวุฒิจากหน่วยงานที่เกี่ยวข้องกับการดำเนินงานของกองทุนยุติธรรม ตลอดจนนักวิชาการจากสถาบันการศึกษาที่เปิดสอนด้านกฎหมาย อาชญาวิทยาและ งานยุติธรรม รวมถึงด้านเศรษฐศาสตร์และการบริหารจัดการ ผลการศึกษาพบแนวทางการบริหารจัดการเพื่อสร้างความเติบโตให้กับกองทุนยุติธรรม คือ 1) การนำเงินบางส่วนจากดอกเบี้ยหรือการส่งเบี้ยประกันภัยของคนทั้งประเทศสมทบเข้าสู่กองทุนยุติธรรม 2) การกำหนดให้มีการหักค่าจ้างทนายความของคนที่มีฐานะดีและประสบกับคดีที่มีมูลค่าทางคดีสูงบางส่วนตามอัตราที่กำหนดสมทบเข้าสู่กองทุนยุติธรรม 3) การนำเงินค่าปรับจากการกระทำผิดที่อาจก่อให้เกิดความเสียหายร้ายแรงหักสมทบเข้าสู่กองทุนยุติธรรม และ 4) การมีนโยบายปล่อยสินเชื่อสำหรับการอำนวยความยุติธรรมแบบถ้วนหน้า ส่วนแนวทางการบริหารจัดการเพื่อสร้างความยั่งยืนให้กับกองทุนยุติธรรม ได้แก่ การมีหลักเกณฑ์การดำเนินงานที่มีประสิทธิภาพ ความชัดเจนของมาตรฐานการดำเนินงานการพัฒนาการบริหารงานบุคคลที่มีประสิทธิภาพ การลดภาระค่าใช้จ่ายที่ไม่จำเป็น การสร้างเครือข่าย การมีส่วนร่วม และการสร้างความเชื่อมั่นให้กับประชาชน ข้อเสนอแนะจากการวิจัย คือ กองทุนยุติธรรมควรมีนโยบายด้านการเพิ่มช่องทางของแหล่งรายได้เพื่อขยายภารกิจการช่วยเหลือได้อย่างกว้างขวางและครอบคลุมมากยิ่งขึ้น สร้างความยั่งยืนด้วย การบริหารจัดการที่มีคุณภาพ โปร่งใส และเป็นธรรม การลดรายจ่ายที่ไม่จำเป็น ตลอดจนการสร้างเครือข่าย การมีส่วนร่วมเพื่อการดำเนินงานที่มีประสิทธิภาพและเกิดความเชื่อมั่นแก่ประชาชน
This research aims to study about process context to help in the legal aid fund for justice process including finding administration guidelines for development and sustainability of the legal aid fund. The data was conducted from documentary and in-depth interview of experts from related units concerned with the legal aid fund as well as academicians from universities who are teaching law, criminology and justice affairs, economics and management as well. The results of this research found that administrative guidelines for creating the development of legal aid fund: 1) brought some money from interest or send insurance premiums of all citizens to the legal aid fund, 2) deducted employment fees from lawyers who had good status and were experienced with high value cases of which the rate of specified contributions went into the legal aid fund, 3) brought fine fees from offense incidents, which causes funds from serious damage contributions to go into the legal aid fund, and 4) had loan policy for enhancing the justice-for-all. Development of administration for creating sustainability of the legal aid fund such as efficient operative criteria, clear standards of operation, development of effective people for administration, reducing unnecessary expenditure, creating participative network, and creating the confidence people. Suggestions from this research are: the legal aid fund should have a policy to expand income in order to extend the mission more widely and more comprehensively. It should also create sustainability by qualified, transparent, and fair administration, deduce unnecessary expenditure as well as creating a participative network to implement it efficiently and make people confident.
