Criminal charge and punishment identification system using elements of crime

Abstract

This thematic paper's objective was to facilitate the users in searching and identifying criminal charge and punishment using elements of crime by non-lawyer users. It aimed to help the non-lawyers who had difficulties in legal information retrieval caused by their use of non-legal keywords in full text while searching for information. The system was developed based on the Thai Criminal Codes (B.E. 2550). The extracted elements of crime and additional conditions affect the change of sentence and punishment from each criminal section heuristically performed. It was developed as a web application and the data was collected in XML format. The system contained 3 parts. The first part allowed the users to select each element of crime sequentially and optionally select conditions to change sentence or punishment. The second part was to show sections from scoped elements of crime and conditions which would be interactively updated. The last part was for displaying the final calculated sentence and punishment. The system was tested and evaluated by five users in the field of law and it received good results. Future research should focus on developing other law domains that could enhance more understanding.

สารนิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อช่วยให้ผู้ใช้งานสามารถค้นหาข้อหาและบทลงโทษทางอาญาได้โดยง่ายโดยให้ผู้ใช้งานเลือกจากองค์ประกอบความผิด เนื่องจากกฎหมายแต่ละประเภทจะใช้คำที่แตกต่างกัน ถ้าผู้ใช้งานทำการค้นหาโดยใช้คำ ที่ไม่ตรงกับกฎหมายนั้น ก็อาจจะทำให้ค้นหาได้ผลลัพธ์ที่ไม่ตรงกับความต้องการหรือค้นหาไม่เจอได้พัฒนาระบบเพื่อใช้ระบุข้อหาและบทลงโทษทางอาญาโดยใช้องค์ประกอบความผิด โดยนำประมวลกฎหมายอาญาฉบับปี พ.ศ. 2550 มาทำการแยกองค์ประกอบความผิดและเงื่อนไขต่าง ๆ ที่มีผลในการเปลี่ยนแปลงโทษ จากนั้นนำมาพัฒนาเป็นเว็บแอพลิเคชัน โดยการจัดเก็บข้อมูลองค์ประกอบ ความผิดและเงื่อนไขในการเปลี่ยนแปลงโทษในรูปแบบเอ็กเอ็มแอลไฟล์ โดยระบบจะแบ่งออกเป็น 3 ส่วน คือ ส่วนที่หนึ่งเป็นส่วนที่แสดงองค์ประกอบความผิดให้ผู้ใช้งานเลือกทีละองค์ประกอบความผิด จนครบทุกองค์ประกอบความผิด ในส่วนของเงื่อนไขที่มีผลต่อการเปลี่ยนแปลงโทษ ผู้ใช้งานสามารถเลือกหรือไม่เลือกก็ได้ ส่วนที่สองเป็นส่วนที่แสดงผลมาตราจากองค์ประกอบความผิดและเงื่อนไขที่ผู้ใช้งานเลือก เมื่อคลิกที่มาตราใด ๆ จะแสดงข้อหาและบทลงโทษทางอาญาของมาตรานั้นและส่วนสุดท้ายจะแสดงผลของบทลงโทษสุดท้ายที่ได้จากการเลือกองค์ประกอบความผิดและเงื่อนไขหลังจากพัฒนาระบบให้พร้อมใช้งาน จึงให้ผู้ใช้งานที่เป็นผู้เชี่ยวชาญทางด้านกฎหมาย จำนวน 5 คน ทำการทดสอบระบบและประเมินผลระบบ ได้ผลการประเมิน 3.74 อยู่ในเกณฑ์ดี ส่วนของการพัฒนาต่อยอดสามารถนำไปพัฒนาต่อยอดกับกฎหมายประเภทอื่น เพื่อเพิ่มความรู้ความเข้าใจในกฎหมายอื่น ๆ มากขึ้น
