ปัญหาการบังคับใช้พระราชบัญญัติคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัว พ.ศ. 2550 ของผู้ปฏิบัติงานในกลุ่มพนักงานสอบสวน

Abstract

การวิจัยนี้เป็นการวิจัยเชิงสำรวจ มีวัตถุประสงค์เพื่อศึกษาปัญหาการบังคับใช้พระราชบัญญัติ คุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัว พ.ศ. 2550 ในกลุ่มพนักงานสอบสวน กลุ่มตัวอย่างคือ พนักงาน สอบสวนในเขตกรุงเทพมหานครจำนวน 221 คน เก็บรวบรวมข้อมูลโดยการตอบแบบสอบถาม วิเคราะห์ข้อมูล โดยการหาค่าความถี่ ร้อยละ ใช้สถิติไคสแควร์และสหสัมพันธ์ของเพียร์สัน ผลการวิจัยพบว่า ปัญหาในการบังคับใช้พระราชบัญญัติคุ้มครองผู้ถูกกระทำด้วยความรุนแรงใน ครอบครัว พ.ศ.2550 ในกลุ่มพนักงานสอบสวน อยู่ในเกณฑ์มีปัญหามากร้อยละ 84.16 พนักงานสอบสวนมีความ รู้อยู่ในระดับสูง ร้อยละ63.80 มีเจตคติไม่เห็นด้วยกับพระราชบัญญัติคุ้มครองผู้ถูกกระทำด้วยความรุนแรงใน ครอบครัว พ.ศ. 2550 ร้อยละ 93.21 คุณลักษณะทั่วไป ด้านเพศ และการอบรมความรู้ มีความสัมพันธ์กับปัญหาการ บังคับใช้พระราชบัญญัติคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัว สถานภาพสมรสไม่มีความสัมพันธ์กับ ปัญหาการบังคับใช้พระราชบัญญัติคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัว ความรู้ของพนักงาน สอบสวนมีความสัมพันธ์เชิงลบในระดับต่ำกับปัญหาการบังคับใช้พระราชบัญญัติคุ้มครองผู้ถูกกระทำด้วยความ รุนแรงในครอบครัว พ.ศ. 2550 (r = -0.281 p-value<0.05) เจตคติของพนักงานสอบสวนมีความสัมพันธ์เชิงลบใน ระดับสูง กับปัญหาการบังคับใช้พระราชบัญญัติคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัว พ.ศ. 2550 (r = -0.726 p-value<0.01) จากผลการวิจัยนี้เสนอแนะให้หน่วยงานที่เกี่ยวข้องควรปรับปรุงหลักเกณฑ์ วิธีการ กำหนดบทบาท หน้าที่ของแต่ละฝ่ายให้ชัดเจนเป็นรูปธรรมสามารถนำไปสู่การปฏิบัติได้อย่างแท้จริง และควรสร้างเจตคติที่ดี ให้แก่พนักงานสอบสวนควบคู่ไปกับการอบรม พนักงานสอบสวนต้องผ่านการอบรมเพื่อให้มีความรู้ความเข้าใจ อย่างถ่องแท้ในการดำเนินคดีเกี่ยวกับความผิดฐานความรุนแรงในครอบครัว อย่างมีระบบ บุคลากรต้องเพียงพอ และควรจัดบุคลากรเพศหญิงให้ปฏิบัติงานด้านนี้โดยเฉพาะ

This research is survey research. It has the purpose to study problems on legal implementation of the Domestic Violence Act B.E. 2550, by inquiry officials. Sample groups were 221 inquiry officials in Bangkok area.Data collection was made by responding to a questionnaire. Data analysis was made by searching of frequency, percentage, using Chi square statistics and Pearson's co-efficient correlations. The research result found that problems on legal implementation of the Domestic Violence Act B.E. 2550, by inquiry officials was in the level of having a lot of problems for 84.16 per cent. Inquiry officials had a high level of knowledge for 63.80 per cent. Inquiry officials who had the attitude of not agreeing with the Domestic Violence Act B.E. 2550 was 93.21 percent.The General characteristics in genders and training for knowledge had a relationship with problems on legal implementation of the Domestic Violence Act B.E. 2550. Marital status did not have a relationship with problems on legal implementation of the Domestic Violence Act B.E. 2550. Knowledge of inquiry officials had a negative relationship with problems on legal implementation of the Domestic Violence Act B.E. 2550 and having a low level of relationship (r= -0.281, p-value <0.05). The attitude of inquiry officials had a negative relationship with problems on legal implementation of the Domestic Violence Act B.E. 2550 and had a high level of relationship (r= -0.726, p-value <0.01). From the results of this research, there are recommendations for related working units to improve criteria, methods, determining roles and duties of each party clearly and in concrete, so that they can be used in practice. There should be the creation of a good attitude to inquiry officials together with training. Inquiry officials should be trained, so that they have a thorough knowledge and understanding of proceedings relating to offences as they use violence in family systematically. There should be sufficient personnel. There should be arrangement of female personnel to do this kind of work specifically
