Abstract
Industrial development projects that involve extraction of minerals createdisputes between states and corporates on one hand and the people living in the targetproject area on the other. The State views land and minerals as economic resources that can be exploited for the achievement of economic growth, while the people demand that the mineral resources be used in a manner that enables them to realize their rights to the basic necessities without fear of any conflict entering their lives. The thesis asked to what extent the human rights framework provided support to people directly impacted by resource conflicts to realise their vision of development. It also assessed the advantages of approaching the issue of resource conflicts through the lens of conflict transformation. The thesis finds that application of conflict analysis tools helps identify the structural violence at the epicenter of such conflicts. The thesis also finds that the conflict transformation lens helps identify a scenario where a compromise can be arrived at between the extreme positions of the primary actors. The thesis further finds that the human rights paradigm helps identify the principles or the stilts upon which such compromise can be accomplished so that it helps build positive peace. In case of resource conflicts the international standards on sustainable mining offer the framework principles for designing such a compromise. The experience of integrating these principles in the domestic legal context in India revealed that if such laws and policies are not implemented with the purpose of transforming the existing structures and relations of power, then their mere enactment not only does not lead to change, but can also entrench the existing status-quo and power relations. In such case, the conflict transformation lens offers the tools for identifying and transforming such roadblocks that the deeper patterns of inequality and injustice existing in society can be addressed.The study concludes that use of human rights lens and the conflict transformation lens complement each other in addressing resource conflicts such as Vedanta and POSCO in sustainable ways.
