การพัฒนาการเข้าถึงความยุติธรรมสำหรับคนยากจน : ศึกษากรณีผู้มารับบริการของหน่วยงานในกระบวนการยุติธรรมภาครัฐ

Abstract

การศึกษาวิจัยนี้มีวัตถุประสงค์ในการศึกษาการพัฒนาการเข้าถึงความยุติธรรมสำหรับคนยากจนในประเทศไทย ศึกษาปัจจัยที่เกี่ยวข้องกับการเข้าถึงความยุติธรรมของคนยากจนและศึกษาปัญหาและอุปสรรคการเข้าถึงความยุติธรรมของคนยากจนในประเทศไทย ประชาชนที่มาขอรับความช่วยเหลือทางด้านกฎหมายจากจังหวัดที่มีปัญหาความยากจนเรื้อรังที่ติดลำดับจังหวัดที่มีสัดส่วนคนจนสูงสุด 10 ลำดับแรกเกือบทุกปี จำนวน 400 คนเป็นประชากรกลุ่มตัวอย่าง และการสัมภาษณ์เจ้าหน้าที่ผู้ปฏิบัติงานในหน่วยงานดังกล่าว โดยใช้แบบสอบถามและแบบสัมภาษณ์เชิงโครงสร้างเป็นเครื่องมือในการเก็บข้อมูล วิเคราะห์ข้อมูลโดยใช้สถิติ Chi-Square และการวิเคราะห์เนื้อหาประกอบ ผลการวิจัยสรุปได้ดังนี้ 1) ด้านข้อมูลส่วนบุคคล พบว่า กลุ่มตัวอย่างส่วนใหญ่เป็นเพศชาย อายุ ระหว่าง 31 - 40 ปี มีสถานภาพสมรสระดับการศึกษาระดับปริญญาตรีหรือเทียบเท่า อาชีพเกษตรกรรม ระยะเวลาการอาศัยในพื้นที่จนถึงปัจจุบันมากกว่า 20 ปี รายได้ครอบครัว (เฉลี่ยรวมต่อเดือน) ต่ำกว่า 10,000 บาท ปัญหาทางกฎหมายที่ประสบหรือเคยประสบ พบว่าส่วนใหญ่มีปัญหาทางคดีเกี่ยวกับที่ดิน รองลงมาได้แก่ คดีแพ่ง 2) ด้านปัจจัยที่สัมพันธ์กับการเข้าถึงความยุติธรรมสำหรับคนยากจนได้แก่ นโยบายรัฐที่ชัดเจน ความร่วมมือในดำเนินการของเอกชน ความรู้ความเข้าใจในการดำเนินคดีของประชาน คุณภาพทนายความ และ 3) ปัญหาและอุปสรรคในการเข้าถึงความยุติธรรมสำหรับคนยากจน ได้แก่ นอกจากปัญหาด้านความล่าช้าในของ คดียังมีปัญหาและอุปสรรคด้านการเดินทางเข้ามาในเขตเมือง การขาดความรู้ความเข้าในกระบวนการดำเนินคดี งบประมาณ การขาดตัวแทนผู้รับผิดชอบทางคดีที่ต่อเนื่อง การให้ความช่วยเหลือไม่ตรงตามที่ต้องการ รวมทั้งการขาดมาตรฐานในการให้ความช่วยเหลือทางกฎหมายแก่ประชาชน ข้อเสนอแนะจากการวิจัย ได้แก่ การจัดอบรมความรู้ทางกฎหมายทางแพ่งที่ตรงตามปัญหาในพื้นที่ประสบแก่ประชาชนและกำหนดให้การช่วยเหลือทางกฎหมายแก่คนยากคนเป็น pro bono สำหรับทนายความอาวุโส กำหนดเจ้าหน้าที่ ผู้รับผิดชอบคดีต่อเนื่อง การวางแนวทางในการให้ความช่วยเหลือทั้งกระบวนการจนเสร็จคดี เร่งรัดการประสานงานการทำคดีให้รวดเร็ว จัดทำระบบฐานข้อมูลให้ทันสมัยที่ประชาชนสามารถเข้าถึงง่าย และจัดทำคู่มือข้อเสนอสำหรับการศึกษาวิจัยต่อไป ควรมีการศึกษาการนำเทคโนโลยี มาใช้ในการเผยแพร่ความรู้ทางกฎหมายอย่างสะดวก ง่าย การมีส่วนร่วมของภาคเอกชนในการให้ความช่วยเหลือทางกฎหมายแก่คนยากจน สำรวจความต้องการการช่วยเหลือทางกฎหมายในพื้นที่

The objectives of this research were to study development of access to justice for the poor in Thailand and to delineate factors related with such access and to analyze the problems and obstacles in access to justice for the poor in a Thailand. Four hundred people who asked for legal assistance from public legal aid units in eight provinces as declared as chronic poverty areas in Thailand were the sample, and twenty-five government officials in such public legal aid units were the key informants in this study. The questionnaire and structural interviewing guidelines were the tools for data collection. The statistical analysis through Chi-Square and content analysis with a descriptive approach were the methods in delineating, the results, as follows: 1.) As for the personal data, the sample was mostly male, aged between 31-40 years of age and married with bachelor degrees and doing agricultural work. They had been living in the area more than twenty years, total family income below ten thousands baht per month, and had problems in land and civil cases. 2.) The factors involved in access to justice for the poor included the concrete policy, cooperative action from the private sector, knowledge and understanding of the operation of legal cases, quality of the lawyer in the case including the legal aid network of the people. 3) In terms of problems and obstacles in access to justice for the poor, in addition to the general problems on case delay, there were still travel barriers in the downtown areas, many aspects, lack of knowledge of the legal process continuity, lack of standard legal aid, the financial, including lack of legal case host and public legal assistance, remain unmet needs of poor people. 4) Recommendations from this study were to continuously train on legal knowledge to meet needs of the people in each area, determine the legal aid as pro bono for the senior lawyers, coordination among the related agencies for the speed of trials, setting up an main responsible official in each case clearly, design and planning the all-end process of the case and making the poor knowledgeable, making the related data base which eases access for the general public, and making the handbooks. The proposal for a future research study should be done in information technology systems for access to legal data in an easy way, the participation of the private sector in access to justice for the poor, and another study should focus on a survey of needs of the poor for legal aid.
