Personal data protection act compliance readiness surveillance tool for organisations

Abstract

The Thai Personal Data Protection Act (PDPA) aims to protect Thaiindividuals' personal information. The PDPA will enter into force in June 2022 for all organisations located in the kingdom of Thailand as well as organisations located outside the kingdom that collect, use, or disclose personal data and provide services toThai individuals. This paper proposes to provide a PDPA compliance readiness surveillance tool for organisations to ensure that they are ready to comply with theAct. The compliance readiness surveillance tool was created by compiling data fromthe Thai Personal Data Protection Act B.E. 2562 and synthesizing it into a set ofquestionnaires. The study's result is a PDPA compliance readiness surveillance tool, which consists of a preliminary assessment and a main assessment and contains a totalof 60 questions in 13 categories given in both Thai and English, that can assist organisations in self-assessing whether their organisation processes are equipped to comply with the Personal Data Protection Act.IMPLICATION OF THE THEMATIC PAPER. Organisations can use this PDPA compliance readiness surveillance tool as a checklist to prepare their work processes to comply with the Act.

พระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคลมีวัตถุประสงค์เพื่อปกป้องข้อมูลส่วนบุคคลของประชาชนไทย จะมีผลบังคับใช้ในเดือนมิถุนายน 2565 สำหรับทุกองค์กรที่ตั้งอยู่ในราชอาณาจักรไทย ตลอดจนองค์กรที่ตั้งอยู่นอกราชอาณาจักรที่มีการเก็บรวบรวม ใช้ หรือเปิดเผยและให้บริการแก่ประชาชนไทย งานวิจัยนี้จึงได้จัดทำเครื่องมือสอบทานความพร้อมในการปฏิบัติตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคลสำหรับองค์กร เพื่อช่วยให้องค์กรสามารถสอบทานความพร้อมขององค์กรในการปฏิบัติตามพระราชบัญญัติ โดยเครื่องมือสอบทานความพร้อมนี้ได้จัดทำขึ้นโดยรวบรวมข้อมูลจากพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 มาสังเคราะห์เป็นชุดแบบสอบถาม ผลลัพธ์ของงานวิจัยนี้ได้แก่ เครื่องมือสอบทานความพร้อมในการปฏิบัติตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล ประกอบไปด้วยแบบประเมินเบื้องต้นและแบบประเมินหลัก โดยมีคำถามรวมทั้งหมด 60 คำถามจาก 13 หมวดหมู่ ทั้งภาษาไทยและอังกฤษ ซึ่งสามารถช่วยเหลือองค์กรต่าง ๆ ในการประเมินตนเองว่ากระบวนการขององค์กรมีความพร้อมในการปฏิบัติตามพระราชบัญญัติคุ้
